General Practitioners (GPs) and allied healthcare professionals working in primary care are regularly required to make decisions with, for and on behalf of patients who lack capacity. In England and Wales, these decisions are made for incapacitated adult patients under the Mental Capacity Act 2005, which primarily requires that decisions are made in the patient’s ‘best interests’. Regarding children, decisions are also made in their best interests but are done so under the Children Act 1989, which places paramount importance on (...) the welfare of the child. Decisions for children are usually made by parents, but a GP may become involved if he or she feels a parent is not acting in the best interests of the child. Internationally, including elsewhere in the UK, different approaches are taken. We hypothesise that, despite the legislation and professional guidelines, there are many different approaches taken by GPs and allied healthcare professionals in England and Wales when making these complex decisions with, for and on behalf of patients who lack capacity. To better understand what is known about how these decisions are made, we plan to undertake a scoping review and directed content analysis of the literature. While the majority of decisions made in primary care are made by GPs, for completeness, this review will include all allied healthcare professionals working in primary care. (shrink)

We study decision under uncertainty in an Anscombe–Aumann framework. Two binary relations characterize a decision-maker: one incomplete relation, reflecting her objective rationality, and a second complete relation, reflecting her subjective rationality. We require the latter to be an extension of the former. Our key axiom is a dominance condition. Our main theorem provides a representation of the two relations. The objectively rational relation has a Bewley-style multiple prior representation. Using this set of priors, we fully characterize the subjectively rational relation (...) in terms of the most optimistic and most pessimistic expected utilities. (shrink)

This paper critically engages with Simon Glendinning’s The Idea of Continental Philosophy. Glendinning purports to show that there can be no coherent philosophical understanding of continental philosophy as comprising any sort of distinct or unified tradition. In this paper, however, I raise some questions about the largely unilateral direction in which his account of the motives for the divide is pursued: analytic philosophy is envisaged as pathologically projecting the internal and unavoidable threat of philosophical failure upon an external ‘continental’ (...) other. I also contend that Glendinning’s claims regarding the lack of thematic and methodological continuity at work in continental philosophy are overstated. Without denying that there is less of a normative consensus undergirding this polyvocal tradition than is evinced in the analytic tradition, in the second half of the paper I will argue for a ‘quasi-unity’ that revolves around the co-imbrication of methodological considerations and what I characterise as continental philosophy’s ‘temporal turn’. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. Capturing the lively modernist milieu of Kenneth Burke's early career in Greenwich Village, where Burke arrived in 1915 fresh from high school in Pittsburgh, this book discovers him as an intellectual apprentice conversing with "the moderns." Burke found himself in the midst of an avant-garde peopled by Malcolm Cowley, Marianne Moore, Jean Toomer, Katherine Anne Porter, William Carlos Williams, Allen Tate, Hart Crane, Alfred Stieglitz, and a host of other fascinating figures. Burke himself, who died in 1993 at the age (...) of 96, has been hailed as America's most brilliant and suggestive critic and the most significant theorist of rhetoric since Cicero. Many schools of thought have claimed him as their own, but Burke has defied classification and indeed has often been considered a solitary, eccentric genius immune to intellectual fashions. But Burke's formative work of the 1920s, when he first defined himself and his work in the context of the modernist conversation, has gone relatively unexamined. Here we see Burke living and working with the crowd of poets, painters, and dramatists affiliated with Others magazine, Stieglitz's "291" gallery, and Eugene O'Neill's Provincetown Players; the leftists associated with the magazines The Masses and Seven Arts; the Dadaists; and the modernist writers working on literary journals like The Dial, where Burke in his capacity as an associate editor saw T. S. Eliot's "The Wasteland" into print for the first time and provided other editorial services for Thomas Mann, e.e. cummings, Ezra Pound, and many other writers of note. Burke also met the iconoclasts of the older generation represented by Theodore Dreiser and H. L. Mencken, the New Humanists, and the literary nationalists who founded Contact and The New Republic. Jack Selzer shows how Burke's own early poems, fiction, and essays emerged from and contributed to the modernist conversation in Greenwich Village. He draws on a wonderfully rich array of letters between Burke and his modernist friends and on the memoirs of his associates to create a vibrant portrait of the young Burke's transformation from aesthete to social critic. Maurice Merleau-Ponty’s work is commonly associated with the philosophical movement called existentialism and its intention to begin with an analysis of the concrete experiences, perceptions, and difficulties, of human existence. However, he never propounded quite the same extreme accounts of radical freedom, being-towards-death, anguished responsibility, and conflicting relations with others, for which existentialism became both famous and notorious in the 1940s and 1950s. Perhaps because of this, he did not initially receive the same amount of attention as his French contemporaries (...) and friends, Jean-Paul Sartre and Simone de Beauvoir. These days though, his phenomenological analyses are arguably being given more attention than either, in both France and in the Anglo-American context, because they retain an ongoing relevance in fields as diverse as cognitive science, medical ethics, ecology, sociology and psychology. Although it is difficult to summarize Merleau-Ponty’s work into neat propositions, we can say that he sought to develop a radical re-description of embodied experience (with a primacy given to studies of perception), and argued that these phenomena could not be suitably understood b y the philosophical tradition because of its tendency to drift between two flawed and equally unsatisfactory alternatives: empiricism and, what he called, intellectualism. This article will seek to explain his understanding of perception, bodily movement, habit, ambiguity, and relations with others, as they were expressed in his key early work, Phenomenology of Perception, before exploring the enigmatic ontology of the chiasm and the flesh that is so evocatively described in his unfinished book, The Visible and the Invisible. This "reply" continues the debate with Simon Glendinning regarding his book The Idea of Continental Philosophy, and pursues my claim that there is a distinctive 'temporal turn' associated with twentieth century continental philosophy. I also offer some family resemblance criteria for continental philosophy.

This essay is an elaboration on some central themes and arguments from my recent book, Chronopathologies: Time and Politics in Deleuze, Derrida, Phenomenology and Analytic Philosophy (Rowman and Littlefield 2012). There is hence an element of generality to this essay that the book itself is better able to justify. But a short programmatic piece has its own virtues, especially for those of us who are time poor (which is pretty much everyone in contemporary academia). Moreover, it adds a dimension to (...) the above book by more explicitly situating it in relation to what is an emerging view in some recent scholarship (such as John McCumber, Len Lawlor, David Hoy, and before this Liz Grosz) that time is central to the identity of continental philosophy, as well as considering some of the work that in different ways contests this kind of interpretation of the identity of continental philosophy (e.g. Simon Glendinning, and, tacitly, Paul Redding). In continuing to side with the former over the latter, I will also develop my argument that time is one of the most significant factors in the divided house that I think contemporary philosophy remains, and I conclude by offering a series of negative prescriptions regarding how we might better avoid particular chronopathologies, or time-sicknesses, that are endemic to these philosophical trajectories, and that are also present (to greater and lesser degrees) in the majority of individual philosophers standardly labelled analytic and continental. To the extent that such sicknesses are at least partly inevitable, akin to a transcendental illusion, this paper consists in a call to be more attentive to this tendency, and to the methodological, metaphilosophical, and ethico-political consequences that follow from them. According to Nicole Oresme (c. 1320–1382), human beings, unlike all other animals, consist of two substances: a thinking substance and a sensing substance. This paper presents and explores the arguments Oresme uses to arrive at this position, which is unusual in medieval philosophical psychology and which at least superficially – though their methods are completely different – resembles what Descartes concluded about the nature of the human soul and body two and a half centuries later. The paper also considers some (...) moments of ambivalence in Oresme’s presentation, as well as unresolved difficulties, several of which have theological as well as philosophical implications. As calls mount for resistance to recent political events, Simon Morgan Wortham explores the political implications and complexities of a psychoanalytic conception of resistance. Through close readings of a range of authors, both within and outwith the psychoanalytic tradition, the question of the politics of psychoanalysis itself is read back into the task of thinking resistance from a psychoanalytic point of view. Morgan Wortham also reveals a new theory of phobic resistance at the centre of the politics of psychoanalysis, (...) one that creates fresh possibilities for contemporary political analysis. Wordsworth wrote that he longed to compose 'some philosophic Song/Of Truth that cherishes our daily life'. Yet he never finished The Recluse, his long philosophical poem. Simon Jarvis argues that Wordsworth's aspiration to 'philosophic song' is central to his greatness, and changed the way English poetry was written. Some critics see Wordworth as a systematic thinker, while for others, he is a poet first, and a thinker only (if at all) second. Jarvis shows instead how essential both philosophy and (...) the 'song' of poetry were to Wordsworth's achievement. Drawing on advanced work in continental philosophy and social theory to address the ideological attacks which have dominated much recent commentary, Jarvis reads Wordsworth's writing both critically and philosophically, to show how Wordsworth thinks through and in verse. This study rethinks the relation between poetry and society itself by analysing the tensions between thinking philosophically and writing poetry. (shrink)

Gerard of Bologna (d. 1317) was the first Carmelite master at the University of Paris in the Middle Ages. In Quaestio 6, article 1 of his incomplete Summa theologiae, Gerard discusses the issue of teaching and learning. During the course of his discussion he summarises his understanding of the process of cognition in human beings and he considers God, angels and human beings as teachers. Gerard insists on the necessity of the teacher-student relationship in the handing on of human knowledge.

A temporal account of the mental capacities for processing information may not be relevant in a context where the goal is to search for storage capacity expressed in chunks. However, if mental capacity and information processing is the question, the time issue can be rehabilitated. A very different temporal viewpoint on capacity limit is proposed in this commentary.

Many recent studies on network technologies and cities share an alarmist view of the impact of technological or regulatory change in utility sectors on the social and spatial fabric of cities, pointing to growing discrimination and inequalities, alienation, enhanced social exclusion and urban “splintering” on a universal scale. A science and technology study perspective on these matters is helpful in moving beyond this “universal alarmism” by emphasizing the ambivalence inherent to all technologies, the significant potential of contestation of, and resistance, (...) to technology-supported forms of discrimination, and the deeply contingent nature of the process of appropriation of new technologies and, as a consequence, of the social “effects” of technologies. Adopting this perspective would mean actively searching for and exploring these context-dependent and often conflictive appropriation processes. For it is in these spaces that we might begin to identify urban technological politics that break free from an intellectually and politically disabling technological pessimism. (shrink)

Intelligent environments aim to provide context-sensitive services to humans in the physical spaces in which they work and live. While the ethical dimensions of these systems have been considered, this is an aspect which requires further analysis. A literature review shows that these approaches are disconnected from each other, and that they are making little impact on real systems being built. This article provides a solution to both of these problems. It synthesises the ethical issues addressed by previous work and (...) highlights other important concerns which have been overlooked so far. Furthermore, it proposes an alternative, more holistic approach that can be used to guide the development of intelligent environments. This book summarizes the ideas about cognitive psychology expressed in the writings of medieval Europeans. Up until the 13th century, Christians who wrote about cognitive psychology, foremost of whom was St. Augustine, did so in the Neoplatonic tradition. The translation of the works of Aristotle and some of the works of Arab scholars into Latin during the 12th and 13th centuries brought a high level of sophistication to the theories. The author touches upon the works of Augustine, Averro^Des, Avicenna, Albertus (...) Magnus, Thomas Aquinas, William of Ockham, and others. (shrink)

In our living we feel and live immersed in a world of elements entities and processes that we treat as if they existed with independence from our distinguish them. From that sensoriality, as a contained belief in our nature, we lead us accepting implicit or explicitly that the act of questioning, deal with opening or discovering an independent world. That manner of thinking cannot be fundament if we in fact understand and take charge certain abstraction of our operating as human (...) and living beings. Historically the theories around this phenomenon is based on the belief that for one side that there isn’t an objective reality but it is a mind or brain phenomena, and for the other side that exist a reality, and this we can know it, if we do thing to discover it. This article try to understand the happening of questioning, without falling in this duality, appealing to certain abstraction of our coherence as observers. En nuestro vivir nos sentimos y vivimos inmersos en un mundo de elementos, entes y procesos que tratamos como si existiesen con independencia de lo que hacemos al distinguirlos. Desde esta sensorialidad, como una creencia contenida en nuestra naturaleza, nos conducimos aceptando explícita o implícitamente que el acto de preguntar consiste en abrir o descubrir un mundo independiente. Ese modo de pensar no se puede fundamentar si de hecho entendemos y nos tomamos en serio ciertas constataciones de nuestro operar como seres humanos y seres vivos. Históricamente las teorías en torno a estos fenómenos se basan en mayor o menor medida en la creencia, por una parte, que no existe una realidad sino que es una invención de la mente y/o cerebro y, por otra, que sí existe una realidad y esta es cognoscible en la medida que hacemos cosas para descubrirla. Este artículo intenta entender el suceder del preguntar sin caer en esta dualidad, apelando a ciertas abstracciones de nuestras coherencias como observadores. (shrink)
